Introduction
These Terms of Service ("Terms") govern your access to and use of the MOCVIEW mobile application, website, and services (collectively, the "Services") provided by MOCVIEW Inc. ("MOCVIEW," "we," "us," or "our").
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.
We may modify these Terms at any time. Revised Terms will be effective from the date of publication. Continued use of the Services after changes constitutes acceptance of the revised Terms.
Definitions
- "You," "User" - Any person or entity using the Services
- "Account" - Your MOCVIEW user account
- "VPx" - Virtual Proxiee, a 60-second video introduction
- "Recording" - Any video content you create using the Services
- "Content" - All information, data, text, videos, and materials
- "Subscription" - Paid access to premium features (Basic or Pro tier)
Eligibility
Age Requirement
You must be at least 16 years old to use the Services. By using the Services, you represent that you are at least 16 years old.
Authority
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Prohibited Users
You may not use the Services if:
- You are under 16 years old
- Your account has been previously terminated for violating these Terms
- You are prohibited by law from accessing the Services
Account Registration and Security
Creating an Account
You may create an account using:
- Google OAuth - Sign in with your Google account
- Apple Sign-In - Sign in with your Apple ID
- LinkedIn OAuth - Sign in with your LinkedIn account
- Magic Link - Sign in via email link
When you authenticate using a third-party provider (Google, Apple, LinkedIn), you agree to comply with their terms of service.
Account Responsibility
You are responsible for:
- Maintaining the security of your account
- All activity that occurs under your account
- Keeping your email address current and accessible
- Notifying us immediately of unauthorized access
You agree to:
- Provide accurate, current information
- Not share your account with others
- Not create multiple accounts to abuse the Services
- Not use another person's account without permission
Account Termination
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent activity
- You abuse the Services or harm other users
- Required by law
You may delete your account at any time through Settings or by contacting support@mocview.com.
Upon termination:
- Your access to the Services will cease
- Your Content may be deleted
- Paid subscriptions are non-refundable (except as required by law)
Subscriptions and Billing
Subscription Tiers
Freemium (Free):
- 2 practice recording credits per month
- 1 VPx version
- Limited features
Basic ($9.99/month or $99/year):
- 10 practice recording credits per month
- 5 VPx versions
- Enhanced features including QR code sharing
Pro ($29.99/month or $299/year):
- Unlimited practice recordings
- Unlimited VPx versions
- Premium features including blockchain certificates
Billing
Payment Processing:
- Processed securely by Stripe
- We do not store your credit card information
Subscription Terms:
- Billed monthly or annually based on your selection
- Automatically renews unless you cancel
- Price changes require 30 days notice
Cancellation:
- Cancel anytime through Settings
- Access continues until end of billing period
- No refunds for partial months (except as required by law)
Taxes:
- Prices exclude applicable taxes
- You are responsible for all taxes
Free Trial (If Offered)
- Free trial terms will be clearly stated at signup
- You must cancel before trial ends to avoid charges
- Limited to one trial per user
- We may require payment information to start trial
Acceptable Use
You May Use the Services To:
- Create professional video introductions (VPx)
- Practice interview skills
- Share your VPx with potential employers
- Receive feedback from evaluators
- Manage your professional documents
You May NOT Use the Services To:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Harass, abuse, or harm others
- Distribute spam or unsolicited communications
- Upload malicious code or viruses
- Attempt to access unauthorized areas
- Scrape or collect data without permission
- Create fake or misleading accounts
- Impersonate others
- Share inappropriate, offensive, or illegal content
- Circumvent technological protections
- Resell or redistribute access to the Services
Content Restrictions
You may not upload or share:
- Illegal content
- Threats or violence
- Harassment or hate speech
- Sexually explicit material
- Private information of others
- Misleading or fraudulent information
- Content that violates third-party rights
Your Content and Intellectual Property
Your Content
You retain ownership of all Content you create and upload to the Services (including VPx recordings, documents, and feedback).
License to MOCVIEW:
By uploading Content, you grant MOCVIEW a limited license to:
- Store and process your Content
- Display your Content according to your privacy settings
- Distribute your Content as you direct (e.g., sharing VPx)
- Use anonymized, aggregated data for analytics and improvements
This license ends when you delete your Content or account, except:
- Content shared publicly may have been copied by others
- Backup copies may persist for up to 90 days
- Anonymized data used in aggregates
MOCVIEW's Intellectual Property
We own all rights to the Services, including:
- MOCVIEW name, logo, and trademarks
- Software, algorithms, and technology
- User interface and design
- Documentation and training materials
You may not:
- Copy, modify, or reverse engineer the Services
- Remove copyright or trademark notices
- Use our trademarks without permission
- Create derivative works based on the Services
Limited License:
We grant you a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. This license ends when your access terminates.
Feedback
If you provide suggestions or feedback about the Services:
- You grant us the right to use your feedback without compensation
- We may incorporate your ideas into the Services
- You waive any claims related to feedback we use
Third-Party Services and OAuth Authentication
OAuth Providers
When you sign in using Google, Apple, or LinkedIn:
- You agree to their respective terms of service and privacy policies
- We receive limited information from them (name, email, profile picture)
- You can revoke OAuth access through their platforms
- Revoking OAuth does not delete your MOCVIEW account
Third-Party Links
The Services may contain links to third-party websites or services:
- We are not responsible for third-party content
- We do not endorse third-party services
- Third-party privacy policies and terms apply
- Access third-party sites at your own risk
Service Providers
We use third-party service providers to operate the Services:
- AWS (video storage)
- Supabase (database)
- Stripe (payments)
- Daily.co (live video)
- Resend (email)
- Firebase (analytics and notifications)
These providers are bound by confidentiality and data protection agreements.
Privacy and Data Protection
Your use of the Services is governed by our Privacy Policy, which is incorporated into these Terms by reference.

- We collect information necessary to provide the Services
- We use industry-standard security measures
- We do not sell your personal information
- You have rights to access, correct, and delete your data

Recording and Sharing
Recording Consent
By creating recordings, you acknowledge that:
- You consent to being recorded
- Your recordings will be processed and stored
- Recordings may be shared according to your settings
- MOCVIEW may apply watermarks for authenticity
Sharing Your VPx
Access Levels:
- Private: Only you and authorized users can view
- Restricted: Video viewable; documents require permission
- Public: Anyone with the link can view
You are responsible for:
- Managing access permissions
- Revoking access when needed
- Understanding that public content may be copied by others
QR Code Sharing
When you generate QR codes:
- Codes provide temporary access to your VPx
- You control expiration and view limits
- You can revoke access at any time
- Standard sharing rules apply
Evaluator Responsibilities
If you serve as an evaluator:
- Provide honest, constructive feedback
- Respect candidate privacy
- Do not share candidate content without permission
- Maintain professionalism
Prohibited Activities
You may not:
- Attempt to gain unauthorized access to the Services
- Interfere with the proper functioning of the Services
- Use automated tools to access the Services (bots, scrapers)
- Reverse engineer or decompile the Services
- Remove or obscure watermarks or security features
- Upload content containing viruses or malicious code
- Engage in activity that could damage our systems
- Violate the privacy or rights of other users
- Use the Services for illegal purposes
- Circumvent subscription or feature restrictions
Disclaimers and Warranties
"AS IS" Provision
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness
- Uninterrupted or error-free operation
- Freedom from viruses or harmful code
No Guarantee of Outcomes
MOCVIEW does not guarantee:
- That you will get a job or interviews
- The quality or accuracy of evaluator feedback
- That your VPx will achieve any specific result
- That recordings will never be deleted or lost (though we use best efforts to prevent this)
Third-Party Services
We are not responsible for:
- Failures of third-party services (OAuth providers, AWS, etc.)
- Actions or policies of third parties
- Content on third-party websites
Independent Decision Making
The Services provide tools and feedback to support your job search, but:
- Hiring decisions are made by employers, not MOCVIEW
- Evaluator feedback is opinion, not guaranteed advice
- You are responsible for your own decisions
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We Are Not Liable For:
- Indirect, incidental, or consequential damages
- Lost profits, data, or opportunities
- Damages resulting from unauthorized access
- Damages from third-party actions
- Damages from service interruptions
- Damages from errors or omissions in Content
Maximum Liability Cap
Our total liability to you for all claims will not exceed the greater of:
- $100, OR
- The amount you paid us in the 6 months before the claim
Exceptions
Some jurisdictions do not allow limitation of liability for:
- Personal injury
- Fraud
- Gross negligence
- Violations of consumer protection laws
In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold harmless MOCVIEW, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your Content
- Your interaction with other users
- Unauthorized use of your account
We reserve the right to assume exclusive defense of any claim, and you will cooperate with us in defending such claims.
Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
Jurisdiction
You agree to the exclusive jurisdiction of the state and federal courts located in Nassau County, New York for any disputes arising from these Terms or the Services.
Informal Resolution
Before filing a lawsuit, you agree to:
- Contact us at legal@mocview.com describing the dispute
- Give us 30 days to resolve the issue informally
Class Action Waiver
You agree not to participate in class action lawsuits against MOCVIEW.
- You may only bring individual claims
- You waive the right to be a class representative or class member
- You may still bring claims in small claims court
If you do not agree to this waiver, do not use the Services.
Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control, including:
- Acts of God (earthquakes, floods, storms)
- War, terrorism, or civil unrest
- Pandemics or public health emergencies
- Government actions or law changes
- Power outages or infrastructure failures
- Strikes or labor disputes
- Cyberattacks or hacking
- Failures of third-party services
Miscellaneous Provisions
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and MOCVIEW.
Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms. We may assign these Terms to:
- An affiliate or subsidiary
- A successor in a merger or acquisition
- A purchaser of substantially all our assets
Survival
Provisions that should survive termination will survive, including:
- Intellectual property rights
- Disclaimers and limitations of liability
- Indemnification
- Dispute resolution

Continued use after changes constitutes acceptance.
Mobile App Specific Terms
App Store Terms
If you download the app from Apple App Store or Google Play:
- You agree to the applicable app store's terms
- App store providers are third-party beneficiaries of these Terms
- We, not the app store, are responsible for the Services
Device Permissions
The app may request permission to access:
- Camera - To record VPx and practice videos
- Microphone - To record audio
- Photos - To upload profile pictures and documents
- Notifications - To send updates and reminders
You can revoke permissions through your device settings.
Updates
We may release updates to fix bugs or add features:
- Some updates may be required to continue using the Services
- Updates may change functionality or features
Mobile Data
Using the app may consume mobile data:
- You are responsible for data charges
- We recommend Wi-Fi for uploading videos
